Introduction
The One World Sight Alliance ("OWSA") is an interactive application website maintained by Lion's Eye Institute for Transplant and Research, Inc. ("LEITR") for the placement and distribution of ocular tissue to the ophthalmic global community. Please feel free to utilize all features on OWSA. At the same time, please remember that your access to OWSA is subject to the following terms, conditions, and notices (the "Terms"), as well as all applicable laws. By accessing and using OWSA, you accept the Terms without limitation or qualification. LEITR may at any time revise these Terms by updating this posting. You are bound by such revisions and should therefore visit this page to review the current Terms from time to time. LEITR reserves the right, without notice and for any reason, to remove any content on this site, and to deny access of any user or users to all or any part of this site.

Downloading
You may download material displayed on OWSA for appropriate businessuse only. You must retain all copyright and other proprietary notices on downloaded and/or copied material. Any copy of material from OWSA you make and distribute for any purpose must also include these Terms. You may not distribute, modify, transmit, use, or reuse any of the contents of OWSA for any public or commercial purpose without the written consent of LEITR.

Copyrights
You should assume everything on OWSA is copyrighted. Images displayed on OWSA are either the property of, or used with permission by, LEITR. Use of these images by you or other third parties is prohibited unless expressly permitted in the Terms or elsewhere on OWSA. Any unauthorized use of these images may violate copyright laws, trademark laws, the laws of privacy and publicity, and other applicable regulations and statutes.

Trademarks
The trademarks, logos, and service marks (the "Trademarks") displayed on OWSA are the property of LEITR and other parties and may be registered and unregistered Trademarks of LEITR and others. Nothing contained on OWSA should be construed as granting by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on OWSA without the written permission of LEITR or such third party that may own the Trademark. Misuse of any Trademarks, or any other content, displayed on OWSA is prohibited. LEITR reserves the right to enforce its intellectual property rights through civil and criminal proceedings.

No Warranties
Except for any express warranties stated on OWSA, if any, the information and services provided or referenced on this site are provided "as is" and with all faults, and the entire risk as to satisfactory quality, performance, accuracy and effort is with the user. While LEITR uses reasonable efforts to include accurate and up-to-date information on the OWSA, LEITR makes no warranties or representations as to its accuracy. LEITR may periodically add, change, or improve any of the information, products, services, programs, and technology described on OWSA without notice. LEITR assumes no liability or responsibility for any errors or omissions in the content of OWSA. In fact, your use of OWSA is at your own risk. Neither LEITR nor any other party involved in creating, producing, or delivering OWSA is liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your access to, or use of, OWSA. For example, LEITR assumes no responsibility for, and will not be liable for, any damages from any viruses which may affect your computer equipment or other property on account of your access to, use of, or downloading from, OWSA.

Product Traceability
In order to accomplish product traceability, LEITR requires end-users to complete recipient follow-up forms on OWSA for each ocular tissue received for transplant. After such information is collected, only data needed for EBAA statistical reporting will be shared with its eye bank members. In case of Adverse Reactions, eye bank members will obtain the form in its entirety. All information is shared in OWSA.

Reimbursement Policy
LEITR agrees to reimburse its member eye banks for all ocular tissue placed for a fee regardless if ocular tissue was lost, destroyed or delayed during transit or thereafter.

Access to Member Areas
Access to and use of member-only, password-protected areas of OWSA are restricted to members of LEITR and authorized users only. Do not share login credentials with third parties or disclose the contents there within. Unauthorized individuals attempting to access these areas of OWSA may be subject to prosecution. Typed in signatures are valid and are considered electronic signatures. Access to your account may become temporarily inactive due to 6 months of inactivity. Your account may be locked due to more than 4 consecutive login failures. Your account may be permanently suspended for misuse of OWSA, any attempt to contact End-User Members of LEITR, or sharing proprietary information with third parties.There is no charge or fees associated with membership. LEITR and member may cancel membership at any time.

No Liability
THE INFORMATION, PRODUCTS, AND SERVICES PUBLISHED ON OWSA MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. INTERNATIONAL SIGHTRESTORATION AND/OR ITS RESPECTIVE SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN OWSA AT ANY TIME. LEITR AND/OR ITS RESPECTIVE SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY OF THE INFORMATION, PRODUCTS, AND SERVICES CONTAINED ON OWSA FOR ANY PURPOSE. IN NO EVENT SHALL LEITR AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF OWSA OR WITH THE DELAY OR INABILITY TO USE OWSA, OR FOR ANY INFORMATION, PRODUCTS, AND SERVICES OBTAINED THROUGH OWSA, OR OTHERWISE ARISING OUT OF THE USE OF OWSA, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF LEITR OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.

Miscellaneous
The Terms will be governed by and construed under the laws of the State of Florida, excluding only its conflict of law provisions. Each party to OWSA Terms hereby submits to the exclusive jurisdiction and venue of the courts within the City of Tampa, County of Hillsborough, State of Florida, U.S.A. and waives any jurisdictional venue or inconvenient forum objections to such courts. Any failure by LEITR to enforce any of its rights under the Terms or applicable laws shall not constitute a waiver of such right.

Privacy Policy
LEITR does not sell or rent nonpublic personal information about our members or former members. LEITR does not share non-public personal information about our members or former members with companies outside of LEITR, except where required or permitted by law. LEITR restricts access to your nonpublic information to its employees who need such information in order to provide products or services to you or to keep your account in good order. In compliance with federal regulations, LEITR maintains physical, electronic and procedural safeguards designed to guard and prevent misuse of your nonpublic personal information.

Internet Privacy Policy
LEITR will utilize any information collected to better understand its user's needs and provide better service. If any personally identificable information has been volunteered, LEITR may utilize that information to notify users about updates to OWSA and/or contact users for marketing purposes. The information that is personally identifiable will not be shared with or sold to any other organization for commercial purposes. Below is a list of non-volunteered information that will be collected automatically when visiting OWSA:

• IP Address of workstation
• Date and time logged in and out

Sharing login details with third parties is prohibited.
